This page sets out the terms and conditions for parents or adult students ("Client") using the services of Xinhua Mandarin Tutoring ("Business").
By learning with us, you agree to the following:
1. Services
The Business connects students with experienced and qualified independent tutors for private online Chinese language lessons. We carefully vet every tutor through photo ID checks, background screening, and interviews to ensure quality and safety.
Before subscribing, clients must purchase a Trial Lesson ($15) with their assigned tutor. This 55-minute session allows our tutors to assess the student's level, understand their goals, and create a personalised learning plan.
Sessions are delivered via Zoom.
The Business will make reasonable efforts to match students with suitable or preferred tutors and ensure continuity.
2. Scheduling
Clients are to schedule lesson times directly with Tutors through their Xinhua account dashboard. The Business does not control, and thus cannot guarantee the availability of any tutor.
3. Payment Terms
Clients agree to pay for their chosen subscription plan in advance via Stripe. Subscriptions are billed fortnightly (every 2 weeks).
4. Cancellations and Makeup Credits
Makeup Credits System
- Cancellations are handled through makeup credits, not cash refunds
- Makeup credits can be used to book one-off lessons within the makeup booking window
- Credits are preserved even after subscription cancellation until used
Business or Tutor Cancellation
- 24+ hours notice: Full makeup credits equal to the lesson value
- Less than 24 hours notice: Full makeup credits + 0.5 bonus credit (worth 30 mins) for the inconvenience
Client Cancellation
- 24+ hours notice: Full makeup credits equal to the lesson value
- Less than 24 hours notice: Full makeup credits - 0.5 credits (worth 30 mins).
No full credit refund will be provided for late cancellations except in exceptional circumstances at the Business' discretion.
Trial Lesson Cancellation
- 24+ hours notice: Trial credit preserved for rebooking
- Less than 24 hours notice or no-show: Trial credit forfeited
No-Shows
- Failure to attend within 20 minutes of your lesson's start time without prior notice results in forfeit of that lesson
- No makeup credits will be awarded
Subscription Cancellation
- Remaining prepaid recurring lessons and makeup credits are preserved until used
5. Conduct Expectations
Students are expected to behave respectfully and follow Tutor instructions during lessons.
The Business reserves the right to terminate services if a student behaves inappropriately or disruptively.
6. Technology Requirements
Clients must ensure they have a stable internet connection and access to a suitable device for online zoom lessons.
The Business is not responsible for technical issues on the client's side.
7. Privacy and Child Safety
- The Business will protect student personal information in line with our Privacy Policy.
- Tutors will maintain professional boundaries and safe, respectful communication.
- In the case that the student is a child, lessons should be booked and observed by parents.
- Students, or parents of students, should report any concerns about tutor conduct immediately to the Business (see section 10 for information regarding how to confidentially contact the Business).
8. Tutor and Business Privacy
- Recording, screenshotting, or distributing any part of a lesson without prior permission from the Tutor is prohibited.
- Students and parents agree to respect the confidentiality of all lesson content and the Tutor, and not to share Tutor details publicly without explicit permission.
- Students and parents agree not to attempt to hire Tutors directly or outside of this service without prior written consent from the Business and Tutor.
9. Limitation of Liability
- The Business acts as a facilitator connecting students with independent tutors.
- The Business is not liable for personal disputes or losses beyond the lesson fees.
- Nothing in this agreement limits rights under Australian Consumer Law.
10. Contacting the Business
Xinhua Mandarin Tutoring Services (the Business) is committed to providing a safe learning environment for all students and tutors. In the case that students have any questions, concerns, feedback, or requests, students can email students@xinhua.com.au. This email address is confidential, and cannot be accessed by any tutor.
11. Agreement and Changes
- By creating a Xinhua account, the Client accepts these terms.
- The Business may update these terms with notice to clients.
